  1. You are the actual or potential Client, Supplier or Vendor of People Can Fly group member, or an Employee of any of those
  2. You are the Person who applies to PEOPLE CAN FLY in one of recruitment processes published on our website.
  3. You are a visitor of our website
  4. You are a participant in on-line/off-line meetings, conferences, videoconferences organized by the PEOPLE CAN FLY group

Who is the Controler of Your personal data?

Whom you can contact regarding processing of your personal data?

What is the purpose of the processing of your personal data and what are legal basis for the processing?

  1. We process your personal data for the purpose of:
    • conclusion and performance of the contract with you, including the entity you represent – including the need to take appropriate actions before concluding the contract, in particular presenting an offer with the possibility of placing an order/inquiry and negotiating the terms of the contract ( basis legal: Article 6 (1) (b) GDPR, ie taking action before concluding a contract and the necessity to perform the contract as well as Art. 1 lit. f) GDPR, i.e. the legitimate interest of communicating with contact persons in the scope of contract performance).
    • investigation or defense against possible claims (legal basis: Art. 6 (1) (f) of the GDPR, ie the legitimate interest of taking debt collection actions or actions related to improper performance of the contract).
  2. We process your personal data for recruitment purposes. In case when the recruitment is aimed at employment on the basis of the provisions of labor law, the legal basis for processing is Art. 221 § 1 of the Labor Code (with regard to the data covered by this article, name, and surname, date of birth, residence address, correspondence address, education, employment). In other cases, the data will be processed on the basis of your consent, pursuant to the Regulation of the European Parliament and of the Council (EU) no. 2016/679 of 27 April 2016 (“GDPR”), in particular art. 6.1.a and art. 9.2.a;
  3. We process your personal data included in Essential Cookies – more about Cookies based on a legitimate interest of the joint-controller (art. 6.1.f) of GDPR). Our legitimate interest is a provision of PeopleCanFly.com website and taking care about it’s security and gather basic statistics. Possible data gathered covers: your source IP address, country of IP address origin, a http referrer – means the site from which you reached us.We may also process your personal data included in Cookies other than Essential Cookies based on your consent (art. 6.1.a) of GDPR), which you may withdraw at any time using our Cookie Consent Kit.
  4. We process your personal data on the basis of the legitimate interest of the joint controller (Article 6.1.f) of the GDPR).

Our legitimate interest is to ensure security and defend against any claims (legal basis: Article 6 (1) (f) of the GDPR. Possible collected data include name, surname, telephone number, e-mail address, communicator ID, communicator nickname, workplace name, IP address.

Are we going to profile your personal data, or take automatic decisions based on your personal data?

No. We are not going to create profiles based on your personal data, or take automatic decisions based on your personal data.

Is it necessary for you to provide us with your personal data?

Your personal data processed based on our legitimate interest is required for us to enable serve PeopleCanFly.com website.
For any other personal data, processed based on your consent – this data is freely given.

What are your rights as Data Subject?

You have the right to:

  1. access to your personal data;
  2. rectification (correction) of your personal data;
  3. withdraw your consent at any time by sending an e-mail to gdpr@peoplecanfly.com. The withdrawal of consent shall not affect the lawfulness of processing based on consent before the withdrawal was done;
  4. restrict processing of your personal data;
  5. erasure of your personal data (the right to be forgotten);
  6. data-portability.

You have the right to contact the responsible supervisory authority of the European Union or the member states at any time in the event of possible breaches of data protection regulations.

How long does PEOPLECANFLY store your data?

a) PEOPLE CAN FLY stores your personal data processed on the basis of our legitimate interest for no longer than 5 years.

PEOPLE CAN FLY stores your personal data processed on the basis of your consent until you withdraw your consent to the processing, but no longer than 5 years.

b) Your personal data will be processed for the entire duration of the current recruitment. After completing the process, the data will be deleted, unless you consent to the process for the purposes of future recruitment. In this case, the data will be processed until you withdraw your consent. If you do not consent to the processing of personal data for the purposes of future recruitment and withdraw your consent to the processing of data, the data will be stored for archival and evidence purposes for a period of 5 years;

c) PEOPLE CAN FLY stores your personal data processed on the basis of our legitimate interest for no longer than 12 months.

PEOPLE CAN FLY stores your personal data processed on the basis of your consent until you withdraw your consent to the processing, but no longer than 12 months.

d) PEOPLE CAN FLY stores your personal data processed on the basis of our legitimate interest for no longer than 12 months.

PEOPLE CAN FLY stores your personal data processed on the basis of your consent until you withdraw your consent to the processing, but no longer than 12 months.

To whom we may disclose your data?

PEOPLE CAN FLY can disclose your personal data to its service providers or vendors e.g.: IT service providers, hosting providers, or marketing solutions providers. However, your personal data will always be treated confidentially and will not be disclosed to third parties who are not acting on our behalf, unless you have consented to its disclosure in writing or electronically or unless we are legally entitled or obliged to do so.

As a global organization we may transfer your data outside of European Economic Area (EEA) – to other People Can Fly companies mentioned as joint-controllers, if it’s necessary to fulfil the legitimate interest of the joint-controllers mentioned above. In this case the transfer is secured by mutual agreements based on standard contractual clauses approved by the European Commission.
